Version of [date]. Effective [date].
This is an agreement between you (the partner) and us. We offer it to all partners on the same terms.
1. Who we are and what the program is
Svoim USA is software at svoimusa.com. It is made and provided by [full legal name in Latin letters], an individual entrepreneur (sole proprietor, "FOP") registered in Ukraine, who owns the software. Address: [address]. Ukrainian tax ID (RNOKPP): [РНОКПП]. In these terms, "we", "us" and "our" mean this entrepreneur. The seller for all buyer orders is Paddle.com (section 2).
In the partner program you tell your audience about Svoim USA and share your own link. If someone buys the software through that link, we pay you a commission, a share of the price.
A buyer who comes through your link pays the normal price. There is no discount through the link. Do not promise one.
2. What to know about Svoim USA so you describe it correctly
- Svoim USA is self-help software. People fill in USCIS form I-765 (work permit) or I-90 (green card replacement or renewal) themselves. USCIS is U.S. Citizenship and Immigration Services.
- The software shows the form questions in English with a translation and puts the answers into the PDF form published by USCIS.
- The software gives no legal advice, does not choose the form or category, does not assess chances and does not file anything.
- Svoim USA is not a substitute for the advice or services of an attorney.
- Not affiliated with USCIS. We are not connected with USCIS or any other government agency.
- The paid part is sold only to people with an address in one of these 16 states: Alabama (AL), Arkansas (AR), Connecticut (CT), Delaware (DE), Hawaii (HI), Idaho (ID), Louisiana (LA), Mississippi (MS), New Hampshire (NH), New Jersey (NJ), Oklahoma (OK), Pennsylvania (PA), South Dakota (SD), Texas (TX), Wisconsin (WI), Wyoming (WY). In Pennsylvania we do not sell in the City of Philadelphia itself; suburbs are allowed.
- Orders are placed through Paddle.com, the Merchant of Record (the official seller). Take prices and descriptions only from our site.
Details: Terms of Service.
3. Who can become a partner
We accept only authors of blogs and channels, admins of groups and communities, and media for Russian- and Ukrainian-speaking people in the U.S. We review every application by hand.
You must be 18 or older and have a bank account that can receive U.S. dollars.
These people cannot be partners:
- attorneys;
- DOJ accredited representatives (people the Department of Justice allows to represent others in immigration cases) and DOJ recognized organizations;
- notaries, "notarios" (a word some people in the U.S. use to pose as lawyers), "immigration consultants";
- anyone who fills in forms for other people, or helps them fill in forms, for a fee (preparers).
The reason: they have their own rules on compensation, and an ad for the software could get mixed up with their paid help.
If you become one of these people, tell us right away. Your participation ends, and we pay commissions for purchases up to that day under section 8.
4. How to apply
Write to partners@svoimusa.com and include:
- your name and contact e-mail;
- links to your blog, channel or group;
- who your audience is: language, where they live, roughly how many people;
- how you plan to talk about Svoim USA;
- this sentence: "I am not an attorney, an accredited representative or a notary, and I do not fill in forms for other people for a fee."
By applying you confirm that you have read these terms. We may refuse without giving a reason.
If we approve you, we send your code and a link like https://svoimusa.com/?ref=CODE. A code has 3–32 Latin letters, digits, "-" or "_". The agreement starts when we send you the code.
5. Which purchases count for you
- A person opens our site through your link. Their browser remembers your code for 30 days.
- If within those 30 days the person pays for a form in the same browser, the purchase counts for you.
- If they later open another partner's link, the last link counts.
- The code works only inside the link. The site has no field where a buyer could type a code.
A purchase does not count if:
- the person bought on another device or in another browser, cleared the browser, or more than 30 days passed;
- the paid part is not sold in their state and we refunded them;
- you bought through your own link (including with the e-mail you gave us for the program);
- the purchase came from a breach of these terms (section 10).
6. How much we pay
- The commission is 10% of the amount the buyer actually paid for the software, excluding sales tax.
- If the buyer paid less than the full price (for example, an early-access deposit was credited), we count what they paid.
- Example: a form costs $49; sales tax is not counted; the commission is $4.90.
- We round down to the cent.
- One purchase, one commission.
- We count and pay the commission in U.S. dollars: the software is sold only in the United States, and payment is in U.S. dollars.
7. When a commission is earned, and what happens on a refund
- After payment, the commission waits 30 days: this is the period in which the buyer can get a refund without giving a reason.
- After 30 days the commission is earned and goes into the next payout.
- If the buyer gets a full refund or disputes the payment with their bank (a chargeback) before we pay the commission, the commission is cancelled.
- If the buyer gets a partial refund, the commission is reduced in the same proportion.
- Sometimes a refund or chargeback happens after we have paid the commission (for example, a refund under the 12-month guarantee). Then we deduct that amount from your next payouts. If there are no more payouts, we may ask you to return that amount.
- If a chargeback dispute is decided in our favor, the commission is restored. If we have already deducted it, we add it to your next payout.
8. Payouts
- We pay once a month, by hand, in U.S. dollars, by bank transfer from the FOP's account in Ukraine. We do not pay in cryptocurrency.
- At the start of the month we tell you how much you have earned. You send an invoice for that amount and your bank details. You send the bank details yourself and are responsible for their accuracy.
- We pay within 15 days after we receive the invoice.
- The minimum payout is $50. A smaller balance carries over to the next month.
- We pay our own bank's fee. Intermediary banks and your bank may deduct their fees, so you may receive less. We do not make up that difference.
- If a transfer comes back because of wrong bank details, we send it again after you give us correct ones.
- You pay your own taxes on your income.
- Before the first payout we may ask for a tax form or a certificate of tax residence (a document saying which country you pay taxes in). The forms are U.S. tax authority (IRS) forms: W-9 for the U.S., W-8BEN for other countries.
- If Ukrainian law requires us to withhold tax from a payout, we will withhold it and tell you.
- You are an independent partner, not our employee or agent. You may not speak or sign anything on our behalf.
9. Required: say that you earn a commission
U.S. law (the rules of the FTC, the Federal Trade Commission) requires you to tell your audience honestly that you are paid for the recommendation.
- In every post, video, story or message with your link, write or say that you earn a commission.
- The statement must be in the language of the post and next to the link. It must be visible right away, without a "more" button. Do not hide it among hashtags or at the end of a long text.
- In a video, say it out loud and also write it in the description next to the link.
Ready-made statements:
- in Russian: «Я получаю комиссию, если вы купите по моей ссылке.»
- in Ukrainian: «Я отримую комісію, якщо ви купите за моїм посиланням.»
- in English: "I earn a commission if you buy through my link."
Also add: "Svoim USA is software for filling in the form yourself. It is not legal help and not a substitute for an attorney."
10. What is prohibited
You may not:
- fill in forms for people or help them fill in forms, whether for money or for free as part of promoting Svoim USA;
- give advice on someone's case: which form or category to choose, what their chances are, what to answer on the form;
- ask people for documents, numbers (SSN is the Social Security number, A-Number is a personal number in the U.S. immigration system) or form answers;
- call yourself or us an immigration "consultant", "notario", "notary", "expert" or "specialist", in any language;
- promise approval, processing times, "no denial", "faster", or say "we file for you";
- speak for USCIS or the government, use their logos, or call Svoim USA official or government software;
- send spam: bulk e-mails or messages without people's consent, repeated comments in other people's groups;
- buy search ads (for example, on Google or Bing) on the word Svoim USA, the address svoimusa.com, or their variants and misspellings;
- pretend to be us: create pages, accounts or sites named Svoim USA, or answer on behalf of our support;
- advertise the paid part as if it were available everywhere. Say that it can be bought only with an address in one of the states on the list above (in Pennsylvania, except the City of Philadelphia itself);
- promise a discount, or post the link on coupon and discount sites;
- make up your own prices or descriptions: take them from our site;
- buy through your own link, create fake purchases, or ask people to buy and then get a refund.
You are responsible for your posts and for following the law where you publish.
11. Review and ending participation
- We spot-check partner posts. If something is wrong, we will ask you to fix or remove the post. Please do it within 3 days.
- If you breach these terms, we may suspend your code or end your participation immediately. In that case we do not pay commissions that are still in their 30-day wait, or commissions for purchases that came from the breach.
- You may leave the program at any time: write to us.
- We may end the program or your participation without a breach by telling you 14 days in advance. We then pay all commissions for purchases up to the last day, after their 30 days pass.
- After your participation ends, the link no longer earns commissions.
12. Your data as a partner
On the site's server (the server is provided by Cloudflare) we keep:
- your code and the name under which we keep records;
- a fingerprint of your e-mail: a short code from which the address cannot be read. It is used only so that we do not pay a commission on your own purchases. The address itself is not stored on the server;
- your status (active, suspended, ended);
- commissions: an internal order code, amounts, dates, refunds and deductions. These records contain no buyer data.
Off the server: your application and our correspondence are in our mailbox (Gmail). Invoices, bank details and tax forms are in the FOP's accounting records and at our bank, which makes the transfer. Bank details are not stored on the site's server.
Why: to count purchases through your link, pay you and follow tax rules. Retention period: [period per the accountant].
About buyers we tell you only the number of purchases and the amounts, without names, e-mails or addresses. More about data and your rights: Privacy Policy.
13. Changes to these terms
We may change these terms. We will post the new version on this page with a date and e-mail you at least 14 days before it takes effect. Purchases made before the change are counted under the previous terms. If you disagree, you may leave the program.
14. Disputes
- Please write to us first: partners@svoimusa.com. We reply within 72 hours.
- The law of Ukraine applies to this agreement. This does not take away the protection that the laws of the place where you live give you.
- If a dispute is not resolved, you can go to court in Ukraine (where we are registered) or to court where you live. You choose.
15. Languages
These terms exist in Russian, Ukrainian and English. If the versions differ, the Russian version prevails.
